Chariot Skates Warranty Indemnity

TERMS AND CONDITIONS

WARNING: Wheelskates are intended for personal and non-commercial use only on private property or, if local laws allow, on public roads, footpaths, and cycle paths. Chariot Skates Ltd makes no warranty as to the legality of Wheelskates on any cycle path, road, pavement, or other public thoroughfare. Should you intend to use Wheelskates in this way, you should seek the prior authority of your relevant transport or traffic agency to do so. By using the Wheelskates you ACCEPT ALL INHERENT RISKS, including those of personal injury, paralysis or death. Improper use or misuse increases your risk. You acknowledge that use of Wheelskates is entirely at your own risk.

1. DEFINITIONS

In this Warranty and Indemnity:

" Chariot Skates " means Chariot Skates Ltd, a company incorporated in accordance with the laws of Hong Kong and is the brand name for the skating product called Wheelskates ;
" Wheelskates " means the product assembled or partly assembled as delivered and not previous owned or used by another party;
" Spare Parts " means all parts as delivered other than the Wheelskates;
" Assorted parts " means parts already attached to the Wheelskates as delivered e.g. padding, straps, buckles;
" Buyer " or " You " means the party that has purchased the Wheelskates, and “" Your " has the corresponding meaning;
" Contract " means the Contract between the Seller and the Buyer for the sale of the Wheelskates;
" Reasonable Use " means use in compliance with all of the following directions;

Wheelskates are designed for commuting & recreational use and should be used carefully & responsibly at all times;
Wheelskates should not be used if the user is unfit, unwell, intoxicated or otherwise not in a physical or mental condition reasonably appropriate for use on public or vehicle access;
Wheelskates are not to carry a total weight of more than 100kg (this means the skater must be under 100kg fully clothed with backpack or other luggage);
Wheelskates are not be used for aggressive skating that involves jumps, high impact or grinding, on or off of ramps or any other structure;
Wheelskates are not be used for continuous commercial or rental use;
Wheelskates should not be used without the wheel or foot protectors;
Wheelskates are not be used if fatigue cracks or damage by impact is detected;
Wheelskates should not be used when there appears to be or if any person identifies a problem with some part of the Wheelskates;
Wheelskates should not be used with a flat or partially deflated tyre, as skating on soft tyres will damage the threads in the tyre wall, making them susceptible to blowouts after next re-inflation;
Wheelskates should not be used with worn tyres, tyres must be regularly checked and replaced as soon as the fabric threads of the casing start to show through the worn rubber;
Wheelskates should be treated as fragile when in storage or transport/shipping and heavy objects should not be placed or rested on them or any of the parts;
Wheelskates and Assorted Parts should only be used in conjunction with parts and material approved by Chariot Skates Ltd;
Wheelskates, Spare Parts and Assorted Parts should not be used other than in compliance with the applicable:

laws, by-laws, regulations and rules of all kinds;
Chariot Skates Assembly Care and Maintenance Instructions;
Chariot Skates Safety Skating & Stopping Instructions;

" Seller " or “We” or “Us” means the Chariot Skates Ltd or a Chariot Skates authorized reseller that sold the Wheelskates to the Buyer, and “Our” has the corresponding meaning;
" Transport costs” means any import duty, freight costs and transit insurance payable by you and communicated by us to you;
" Warranty " means this Warranty and Inde

" Warranty Period " means 24 months commencing on the Start Date.
" Start Date " means the date the Wheelskates are delivered to the Buyer.

2. TERMS OF SALE

2.1 Orders

We are under no obligation to accept any application or order. Only applications/orders from potential buyers that have agreed to the terms of this warranty will be considered for acceptance. If we decline your order any money received by us from you for such order will be refunded in full. There will be no binding agreement between you and us until we have accepted your application/order and notified you of this. Our notification will be acceptance of your offer to purchase our Wheelskates.

2.2 Price

The price payable is the price stated on our website at the time of placing your order. In some circumstances you will be able to pay a deposit to secure your order; you will pay the balance of the purchase price in full at the time and in the manner communicated by us. If you cancel your order prior to paying the balance, your deposit will be fully refunded.

2.3 Delivery

On our acceptance of your order and receipt of your payment, we will deliver the Wheelskates ordered to the location specified in your order.

We will make reasonable efforts to deliver the Wheelskates within the expected delivery time (as communicated via our website or in direct correspondence). However, we will not be liable for any loss or damage resulting directly or indirectly from a failure to deliver within the expected delivery times.

Delivery occurs when our carrier leaves the Wheelskates at the location specified in your order.

2.4 Risk

The Risk of loss of or damage to the Wheelskates passes from us to you on delivery. We will not be responsible for any loss of or damage that occurs following delivery.

2.5 Returns

We will only accept the return of your Wheelskates after we have first given approval. You must contact us by email, webform or telephone before initiating any return.

Refunds will only be available on the following terms:

you must notify us by email, webform or telephone within 15 working days of the Wheelskates being delivered to you detailing that you wish to return the Wheelskates for a refund of the purchase price; and
we will advise you whether we will accept return of the Wheelskates; and
if we accept return of the Wheelskates we will send you a RMA (Return Merchandise Authorization) number; and
we will arrange for a courier to pick up the Wheelskates from the address you have supplied to us, within ten days after we send the RMA number to you; and
you must ensure the Wheelskates are picked-up by our courier in an unused condition and in their original packaging; and
all Transport Costs for return of the Wheelskates to us will be at your expense; and
risk of loss or damage to the Wheelskates during transit on return to us will be your sole responsibility. If you wish to insure the Wheelskates during transit on return to us you must arrange and pay for appropriate transit insurance accordingly; and
We will inspect the returned Wheelskates. If it is received in an unused condition and in its original packaging we will refund you the purchase price. If it is not received in an unused condition and in its original packaging, we will not accept return of the Wheelskates. No refund will be issued by us, and you will be informed that the Wheelskates are available for collection. You will be responsible for all Transport Costs for return of the Wheelskates

We will not accept returns of clothing, protective gear, carry bags and accessories except in the case of a manufacturing defect covered by our Warranty.

3. WARRANTY

If you are dissatisfied or an issue arises with your Wheelskates please contact us and we will endeavour to resolve the issue.

3.1 General

3.1.1 The Warranty forms part of the Contract.

The Warranty expires at the end of the Warranty Period
The Buyer must provide proof of delivery by providing copies of shipping documents otherwise the Start Date is the date this Warranty was accepted on-line at Chariot Skates’ web site.

3.1.2 The Seller warrants to the Buyer that the Wheelskates Parts will be free from defects in materials and workmanship for the Warranty Period.

3.1.3 Notwithstanding anything in the Warranty, the Buyer acknowledges and agrees that Wheelskates Parts may require repair or replacement due to normal wear and tear such as tyres, tubes and other parts in accordance with the table in Schedule 1 before the end of the Warranty Period.

The Warranty does not apply to damage to or, fault in or failure or malfunction or Wheelskates resulting from:

wear and tear of items specified in Schedule 1
wear and tear from continuous use such as commercial or rental use*
any act of vandalism or accident, including collision with any object

3.1.4 The Seller's and Chariot Skates' liability to the Buyer in relation to any Warranty claim made by the Buyer is limited to the price paid for the Wheelskates.

3.1.5 Any warranty contained in the Warranty is non-transferable.

3.2 Defects

3.2.1 The Buyer must immediately upon receipt of the Wheelskates undertake a full inspection of the Wheelskates for any defects or damage that may have occurred during shipping.

3.2.2 If at any time the Buyer reasonably believes that the Wheelskates contains a defect, the Buyer must as soon as practicable:

Cease further use of the Wheelskates;
notify the Seller of the purported defect in the Wheelskates;

3.2.3 We may require photographic verification or a Service Agent to inspect the Wheelskates before we accept or reject any warranty claim. If we require the Wheelskates to be inspected by us or a Service Agent, we will issue you with a RMA (Return Merchandise Authorization) number and we will arrange for the Wheelskates to be transported to an address specified by us for further assessment.

3.2.4 If we accept your warranty claim we will, at our option:

replace the Wheelskates at our cost, including Transport Cost; or
repair the Wheelskates at our cost, including Transport Cost; or
send you replacement parts at our cost, if the defect can be fixed by user procedure. Fitting the parts will be your responsibility

If we repair or replace the Wheelskates; the Warranty will continue to apply only for the remainder of the Warranty Period for the Wheelskates we originally supplied;
If we send you replacement parts to fix the Wheelskates by user procedure, we warrant to you that the replacement parts will be free from any material manufacturing defects for 90 days from receipt by you of the replacement parts or the remainder of the Warranty Period for the Wheelskates we originally supplied, whichever is the greater.
If we reject your warranty claim, you may choose to have the Wheelskates repaired at your cost, or, if the Wheelskates were sent to us or a Service Agent, returned without repair. In either case you will be responsible for all Transport Costs to and from us or a Service Agent. You will bear the risk of loss of or damage to the Wheelskates during return transportation of the Wheelskates to you.
If we require the Wheelskates to be inspected, you will be required to package the Wheelskates in the original or appropriate packaging to protect the Wheelskates from damage during transit and make it available for pickup by our courier within ten days after we send the RMA number to you or otherwise notify you of our arrangements. The courier will not be authorised to accept any Wheelskates not properly packaged. If the original packaging has not been used for a return and we determine the packaging is inappropriate to protect the Wheelskates from damage during transit we may choose to replace non-original packaging with an original Wheelskates box for the return trip at your expense. You agree to pay all invoices issued to you by us or a Service Agent in accordance with these Terms and you further agree that we or a Service Agent will be entitled to retain possession of your Wheelskates until all such invoices have been paid in full.

3.2.5 Subject to the Buyer having fully complied with clause 3.2, if any part of the Wheelskates is defective the Seller must procure, in its discretion, either the repair or replacement of the defective parts of the Wheelskates.

3.3 Warranty limitations

3.3.1 Notwithstanding anything in the Warranty, the Seller is not obliged to procure repair or replacement and the Buyer is not entitled to compensation from the Seller or Chariot Skates in relation to a defect in the Wheelskates if the Buyer:

fails to fully comply with clause 3.2.2;
fails to promptly discover a defect which the Buyer ought reasonably to have discovered; or
allows or permits repairs or modifications or any other changes to the Wheelskates by a party other than the Seller or Chariot Skates or a party appointed by or approved in writing by the Seller or Chariot Skates.

3.3.2 Notwithstanding anything in the Warranty, neither the Seller nor Chariot Skates is liable to the Buyer in relation to damage to the Wheelskates caused by:

wear and tear;
accident;
vandalism;
neglect;
improper or negligent set-up, installation, transport, repair or maintenance of the Wheelskates;
repair, modifications or any other changes to the Wheelskates by a party other than the Seller or Chariot Skates or a party appointed by or approved in writing by the Seller or Chariot Skates; or
use of the Wheelskates other than Reasonable Use.

4. INDEMNITY

Neither, the Seller nor Chariot Skates is liable to the Buyer for, and the Buyer agrees to fully indemnify the Seller and Chariot Skates in relation to, loss or damage to any person or property from use of the Wheelskates caused by:

accident;
improper or negligent set-up, installation, packing, transport, repair or maintenance of the Wheelskates;
repair, modifications or any other changes to the Wheelskates by a party other than the Seller or Chariot Skates or a party appointed by or approved in writing by the Seller or Wheelskates; or
use of the Wheelskates other than Reasonable Use.

5. LIMITED LIABILITY

Save as expressly provided in clauses 2 and 3 the Seller nor Chariot Skates shall have no liability whatsoever to the Buyer for any indirect, special, consequential or incidental loss or damage of any kind suffered or incurred by the Buyer howsoever caused or arising, whether from breach or non-performance of any of its obligations under the Contract or from the supply, installation, performance, operations or use of the Wheelskates.

6. ACKNOWLEDGEMENTS

The Buyer acknowledges that prior to using the Wheelskates, and in order to have the benefit of this Warranty, the Buyer must read and comply with these documents:

Chariot Skates Assembly Care and Maintenance Instructions;
Chariot Skates Safety Skating & Stopping Instructions

The Buyer acknowledges that the above documents can be downloaded from the official Chariot Skates web site at any time.

SCHEDULE 1 - EXPECTED LIFE-SPAN OF WHEELSKATES PARTS WITHIN WARRANTY PERIOD

Some parts may require repair and replacement by the Buyer within the Warranty Period based on the amount of use.
