WARNING: Wheelskates are intended for personal and non-commercial use only on private property or, if local laws allow, on public roads, footpaths, and cycle paths. Chariot Skates Ltd makes no warranty as to the legality of Wheelskates on any cycle path, road, pavement, or other public thoroughfare. Should you intend to use Wheelskates in this way, you should seek the prior authority of your relevant transport or traffic agency to do so. By using the Wheelskates you ACCEPT ALL INHERENT RISKS, including those of personal injury, paralysis or death. Improper use or misuse increases your risk. You acknowledge that use of Wheelskates is entirely at your own risk.
In this Warranty and Indemnity:
2.1 Orders
We are under no obligation to accept any application or order. Only applications/orders from potential buyers that have agreed to the terms of this warranty will be considered for acceptance. If we decline your order any money received by us from you for such order will be refunded in full. There will be no binding agreement between you and us until we have accepted your application/order and notified you of this. Our notification will be acceptance of your offer to purchase our Wheelskates.
2.2 Price
The price payable is the price stated on our website at the time of placing your order. In some circumstances you will be able to pay a deposit to secure your order; you will pay the balance of the purchase price in full at the time and in the manner communicated by us. If you cancel your order prior to paying the balance, your deposit will be fully refunded.
2.3 Delivery
On our acceptance of your order and receipt of your payment, we will deliver the Wheelskates ordered to the location specified in your order.
We will make reasonable efforts to deliver the Wheelskates within the expected delivery time (as communicated via our website or in direct correspondence). However, we will not be liable for any loss or damage resulting directly or indirectly from a failure to deliver within the expected delivery times.
Delivery occurs when our carrier leaves the Wheelskates at the location specified in your order.
2.4 Risk
The Risk of loss of or damage to the Wheelskates passes from us to you on delivery. We will not be responsible for any loss of or damage that occurs following delivery.
2.5 Returns
We will only accept the return of your Wheelskates after we have first given approval. You must contact us by email, webform or telephone before initiating any return.
Refunds will only be available on the following terms:
We will not accept returns of clothing, protective gear, carry bags and accessories except in the case of a manufacturing defect covered by our Warranty.
If you are dissatisfied or an issue arises with your Wheelskates please contact us and we will endeavour to resolve the issue.
3.1 General
3.1.1 The Warranty forms part of the Contract.
3.1.2 The Seller warrants to the Buyer that the Wheelskates Parts will be free from defects in materials and workmanship for the Warranty Period.
3.1.3 Notwithstanding anything in the Warranty, the Buyer acknowledges and agrees that Wheelskates Parts may require repair or replacement due to normal wear and tear such as tyres, tubes and other parts in accordance with the table in Schedule 1 before the end of the Warranty Period.
The Warranty does not apply to damage to or, fault in or failure or malfunction or Wheelskates resulting from:3.1.4 The Seller's and Chariot Skates' liability to the Buyer in relation to any Warranty claim made by the Buyer is limited to the price paid for the Wheelskates.
3.1.5 Any warranty contained in the Warranty is non-transferable.
3.2 Defects
3.2.1 The Buyer must immediately upon receipt of the Wheelskates undertake a full inspection of the Wheelskates for any defects or damage that may have occurred during shipping.
3.2.2 If at any time the Buyer reasonably believes that the Wheelskates contains a defect, the Buyer must as soon as practicable:
3.2.3 We may require photographic verification or a Service Agent to inspect the Wheelskates before we accept or reject any warranty claim. If we require the Wheelskates to be inspected by us or a Service Agent, we will issue you with a RMA (Return Merchandise Authorization) number and we will arrange for the Wheelskates to be transported to an address specified by us for further assessment.
3.2.4 If we accept your warranty claim we will, at our option:
3.2.5 Subject to the Buyer having fully complied with clause 3.2, if any part of the Wheelskates is defective the Seller must procure, in its discretion, either the repair or replacement of the defective parts of the Wheelskates.
3.3 Warranty limitations
3.3.1 Notwithstanding anything in the Warranty, the Seller is not obliged to procure repair or replacement and the Buyer is not entitled to compensation from the Seller or Chariot Skates in relation to a defect in the Wheelskates if the Buyer:
3.3.2 Notwithstanding anything in the Warranty, neither the Seller nor Chariot Skates is liable to the Buyer in relation to damage to the Wheelskates caused by:
Save as expressly provided in clauses 2 and 3 the Seller nor Chariot Skates shall have no liability whatsoever to the Buyer for any indirect, special, consequential or incidental loss or damage of any kind suffered or incurred by the Buyer howsoever caused or arising, whether from breach or non-performance of any of its obligations under the Contract or from the supply, installation, performance, operations or use of the Wheelskates.
The Buyer acknowledges that prior to using the Wheelskates, and in order to have the benefit of this Warranty, the Buyer must read and comply with these documents:
The Buyer acknowledges that the above documents can be downloaded from the official Chariot Skates web site at any time.
Some parts may require repair and replacement by the Buyer within the Warranty Period based on the amount of use.
